Terms & Conditions

Copyright & Licensing

  • The Photographer retains full copyright to all images created during the session.

  • Clients are granted a non-transferable, non-commercial license to use the final images for personal purposes, such as printing and social media sharing (with appropriate credit).

  • Commercial or promotional use of any images requires prior written consent and may be subject to additional licensing fees.

    Model Release

  • By booking a session, the Client grants the Photographer permission to use images for portfolio display, promotional materials, website, and social media unless a written request is submitted to withhold the images from public use.

    Session Expectations

  • The Client agrees to arrive on time and fully prepared for the session.

  • The Photographer is not responsible for session delays caused by the Client or third parties.

  • When children or pets are involved, the Client is responsible for their supervision and cooperation throughout the session.

    Liability

  • The Photographer shall not be held liable for any damages, losses, or missed sessions resulting from circumstances beyond their control (e.g., weather, technical failure, or emergencies).

  • In the rare event of a complete photographic failure, the Photographer’s liability is limited to a full refund of any payments received.

    Image Editing & Retouching

  • Basic editing and color correction are included in all packages.

  • Advanced retouching (e.g., body modification, object removal) is available for an additional fee upon request.

  • Requests for additional editing must be submitted.

    Image Delivery & Storage

  • Final edited images will be delivered promptly.

  • Images will be archived for up to six (6) months after delivery.

  • Clients are responsible for downloading and securely backing up all delivered files.

    Travel & Accommodation

  • Travel fees apply for all sessions conducted.

  • For destinations requiring overnight stays, the Client agrees to cover reasonable travel and accommodation costs, to be discussed and approved in advance.

    Permits & Access

  • It is the Client’s responsibility to secure necessary permits or pay any location-related fees.

  • The Photographer will not be held liable for delays or cancellations resulting from a lack of access or proper authorization.

    Late Arrivals & No-Shows

  • Clients arriving late may receive reduced session time without a price adjustment.

  • If the Client does not arrive or make contact within 45 minutes of the scheduled session time, the appointment will be canceled and the deposit forfeited.

    Force Majeure

  • In cases of unforeseeable events (e.g., natural disasters, pandemics, government restrictions), both parties agree to reschedule without penalty when possible.

  • If rescheduling is not feasible, the Photographer may, at their discretion, offer a partial refund.

    Prints & Third-Party Labs

  • The Photographer cannot guarantee print quality from third-party printing labs not recommended by us.

    Indemnification

  • The Client agrees to indemnify and hold harmless the Photographer from any claims, damages, or liabilities arising from improper or unauthorized use of the images.

    Non-Disparagement

  • The Client agrees to refrain from making public statements that may damage the Photographer’s reputation.

  • Any concerns should be communicated privately and resolved professionally.

    Dispute Resolution

  • In the event of a dispute, both parties agree to pursue mediation as a first step before considering legal action.

    Taxes

  • All services are subject to applicable provincial and federal sales taxes as required by law.

    Minors

  • If individuals being photographed are under the age of 18, the Client affirms they are the legal parent or guardian and grants permission for participation in the session.

    Governing Law

  • The laws of the Province of Alberta, Canada, govern these Terms and Conditions.

  • Any disputes shall be resolved in the courts of that jurisdiction.
